These Terms of Service ("Terms") apply when you visit lotikids.no, use our website or purchase products from LOTI KIDS.

By using our website or placing an order, you agree to these Terms together with the policies referred to in them. Nothing in these Terms limits any mandatory rights you have as a consumer under Norwegian law.

1. About LOTI KIDS

LOTI KIDS is an online toy store operated by Nordic MasterCraft AS.

Throughout these Terms, "LOTI KIDS", "we", "us" and "our" refer to Nordic MasterCraft AS trading as LOTI KIDS.

"Customer", "you" and "your" refer to the person using our website or purchasing products from us.

Shopify provides the e-commerce platform used to operate our online store. Purchases made through LOTI KIDS are agreements between you and Nordic MasterCraft AS, not between you and Shopify.

2. Use of Our Website

You may use our website for lawful personal purposes.

You must not:

• Use the website for unlawful or fraudulent purposes

• Attempt to interfere with the security or operation of the website

• Introduce viruses, malicious code or other harmful technology

• Attempt to gain unauthorized access to our systems

• Collect personal information about other users without authorization

• Copy or commercially exploit substantial parts of our website without permission

• Use the website in a way that infringes the rights of LOTI KIDS or another person

We may restrict access to the website where reasonably necessary to protect our business, customers or systems.

3. Products

We make reasonable efforts to ensure that product descriptions, photographs, specifications, dimensions, recommended ages and other product information displayed on LOTI KIDS are accurate.

However, minor differences may occur.

Colors may appear differently depending on your screen, device and display settings.

Product packaging, design or other minor details may also be changed by a manufacturer without affecting the essential characteristics or functionality of the product.

Where a product contains specific safety instructions, age recommendations or warnings, these should always be followed.

Product availability may change without notice.

5. Orders

When you place an order through LOTI KIDS, you submit an offer to purchase the products in your order.

After placing your order, you will receive an electronic confirmation.

The purchase agreement is formed in accordance with the information presented during checkout and the order confirmation.

You are responsible for ensuring that the information you provide when ordering is correct, including your:

• Name

• Email address

• Phone number

• Billing information

• Delivery address

If you discover an error after placing your order, please contact us as soon as possible at support@lotikids.com.

We may refuse or cancel an order where there is a legitimate reason to do so, for example where:

• A product is unavailable

• There has been an obvious pricing or technical error

• Payment cannot be authorized

• We reasonably suspect fraud or misuse

• We cannot legally supply the product

If we cancel an order after payment has been received, the relevant amount will be refunded.

6. Payment

Available payment methods are displayed during checkout.

Payments are processed through the payment provider associated with the payment method you select.

LOTI KIDS does not directly store your complete payment card details.

Payment providers may have additional terms and privacy policies that apply to their services.

7. Shipping and Delivery

Available shipping methods, delivery charges and estimated delivery information are displayed during checkout or in our Shipping Policy.

LOTI KIDS may use shipping providers including Bring/Posten and PostNord.

Delivery times shown on our website are estimates unless a specific delivery time has expressly been agreed.

We aim to dispatch and deliver orders within the stated timeframe, but circumstances outside our reasonable control may occasionally cause delays.

If a delivery is materially delayed, please contact us so that we can investigate.

Your statutory rights relating to delayed delivery are not affected by these Terms.

LOTI KIDS remains responsible for the goods during delivery to the extent required under applicable Norwegian consumer law.

8. Right of Withdrawal

Consumers purchasing goods online generally have a statutory right of withdrawal in accordance with the Norwegian Right of Withdrawal Act (angrerettloven).

For products covered by the statutory right of withdrawal, the withdrawal period is normally 14 days from the relevant starting point under applicable law, including receipt of the goods where applicable.

To exercise your right of withdrawal, you must notify us clearly that you wish to withdraw from the purchase within the applicable withdrawal period.

After notifying us, the goods must be returned within the period required by applicable law.

Unless otherwise required by law or agreed by LOTI KIDS, the customer is responsible for the direct cost of returning goods when exercising the right of withdrawal.

Products should be handled only to the extent necessary to establish their nature, characteristics and function. A reduction in value resulting from handling beyond what is necessary may be deducted from the refund where permitted by law.

Certain products or circumstances may be exempt from the statutory right of withdrawal where provided by law.

9. Returns and Refunds

Returns, refunds and exchanges are handled according to our Refund & Return Policy and applicable Norwegian consumer legislation.

The statutory right of withdrawal and your rights concerning defective products are separate rights.

Nothing in our Refund & Return Policy or these Terms limits rights that cannot legally be limited under Norwegian consumer law.

10. Complaints and Defective Products

If a product has a defect or does not correspond to what was agreed, you may have rights under the Norwegian Consumer Purchases Act (forbrukerkjøpsloven).

Please contact us as soon as reasonably possible after discovering a problem.

Please include your order number and a description of the problem. Photographs may be requested where they are reasonably useful for assessing the issue.

Depending on the circumstances and applicable law, remedies may include repair, replacement, price reduction, cancellation of the purchase or refund.

Your statutory complaint rights are not affected by any voluntary return policy offered by LOTI KIDS.

11. Damaged or Incorrect Orders

If you receive an incorrect product or an item that appears damaged upon delivery, please contact us as soon as possible at support@lotikids.com.

Please provide your order number and information about the problem. Where helpful, we may ask you to provide photographs of the product and packaging so that we can investigate the issue.

We will handle the matter in accordance with applicable Norwegian consumer law.

12. Product Safety

LOTI KIDS sells toys and children's products that may have age recommendations, safety warnings, assembly requirements or instructions for adult supervision.

Customers should read and follow all safety information, instructions, age recommendations and warnings supplied with a product.

Age recommendations should be considered when selecting products for children.

Some products may contain small parts or other elements that are unsuitable for younger children.

If you have questions about the suitability of a product, please contact us before purchase.

Nothing in this section excludes or limits LOTI KIDS' responsibilities under applicable product safety or consumer protection legislation.

13. Promotions and Discount Codes

From time to time, LOTI KIDS may offer discount codes, promotions or special offers.

Unless otherwise stated:

• Discount codes cannot be exchanged for cash

• Discount codes may have an expiry date

• Certain products may be excluded

• Only one discount code may be used per order

• A discount code must be entered before completing checkout

Specific promotional terms presented with an offer will apply in addition to these Terms.

We may cancel or refuse a discount obtained through fraud, misuse or an obvious technical error.

14. Intellectual Property

The LOTI KIDS website and its original content, branding, graphics, photographs, text, design elements and logos are protected by applicable intellectual property laws.

Content belonging to manufacturers, Shopify or other third parties remains the property of the respective rights holder.

You may use the website for personal, non-commercial purposes.

You may not reproduce, distribute, modify, republish or commercially exploit protected LOTI KIDS content without our prior permission, except where permitted by law.

15. Reviews and Customer Content

If you submit a product review, photograph, comment or other content to LOTI KIDS, you confirm that you have the right to submit that content.

You must not submit content that:

• Is unlawful

• Infringes another person's rights

• Contains malicious software

• Is deliberately false or misleading

• Contains inappropriate personal information about another person

Where you submit content for publication on our website, you grant LOTI KIDS the rights reasonably necessary to display and use that content in connection with operating and promoting our store, subject to applicable law.

We may remove customer content where there is a legitimate reason to do so.

16. Third-Party Services and Links

Our website may contain links to or integrations with services operated by third parties, including payment, delivery, social media or other technology providers.

Third-party services may have their own terms and privacy policies.

LOTI KIDS is not responsible for independent third-party websites that we do not control.

17. Shopify

LOTI KIDS is powered by Shopify, which provides the e-commerce technology used to operate our store.

However, products purchased through LOTI KIDS are sold by Nordic MasterCraft AS trading as LOTI KIDS.

Shopify is not the seller of the products purchased from LOTI KIDS.

Shopify's own terms and privacy policies may apply to services or processing carried out independently by Shopify.

18. Privacy

We process personal information in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR and Norwegian data protection legislation.

19. Website Availability and Errors

We aim to keep our website accurate and available.

However, we cannot guarantee that the website will always be uninterrupted or completely free from technical errors.

Occasionally, information may contain typographical errors or inaccuracies concerning matters such as product descriptions, availability or prices.

We may correct such errors when discovered.

Nothing in this section affects an order or consumer right where applicable law provides otherwise.

20. Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

LOTI KIDS is responsible for its obligations under applicable Norwegian consumer legislation.

To the extent permitted by law, we are not responsible for losses caused solely by circumstances outside our reasonable control or losses that were not reasonably foreseeable as a consequence of our breach.

Nothing in these Terms limits your mandatory rights as a consumer.

21. Events Outside Our Control

We are not responsible for failure or delay caused by circumstances outside our reasonable control, provided this does not remove rights you have under mandatory consumer law.

Such circumstances may include serious transport disruption, natural disasters, major technical failures, strikes, governmental restrictions or similar extraordinary events.

If such an event materially affects your order, we will take reasonable steps to inform you and manage the situation.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices or applicable law.

The version applicable to your purchase will generally be the version in effect when your order was placed, unless otherwise required by law.

The current version will be available on our website.

23. Governing Law and Disputes

These Terms and purchases from LOTI KIDS are governed by Norwegian law, subject to any mandatory consumer protections that apply to you.

If you have a complaint or dispute, please contact us first at support@lotikids.com so that we can try to resolve the matter.

Consumers may also have the right to seek assistance from the relevant Norwegian consumer dispute resolution authorities.

Nothing in these Terms prevents a consumer from exercising rights regarding jurisdiction or dispute resolution provided by mandatory law.
